Who We Are
Building Bones is a trading name of Building Health Technologies Limited, a company registered in Ireland under company number 780848, with its registered office at Three Bridges House, Killonerry, Piltown, County Kilkenny, E32 X265, Ireland, and operating in the United Kingdom under Building Health Technologies UK Limited, UK establishment number BR027750 (together, "Building Bones", "we", "our" or "us"). Building Bones is a digital health company. Our goal is to empower and support people by giving them tools to support their bone health. We do this using evidence-based and behavioural interventions supported by our Digital Platform.
Our mission is to provide accessible, affordable and effective bone health information and care.

Changes to this Terms and Conditions
We may update Our Terms and Conditions from time to time. You will receive a notification within the Building Bones Platform regarding any changes.
We will let You know via email and/or a prominent notice on Our Service and update the "Revision" and “Revision Date” at the top of these Terms and Conditions.
You are advised to review these Terms and Conditions periodically for any changes. Changes to this Terms and Conditions are effective when they are published, which you will be notified of.
What is Building Bones
The Building Bones Platform ("Platform") refers to the software program provided by the Company. The Platform has two main components made available to you (the "User"):
The Building Bones App (for Patient Users): This is a mobile application that delivers a program for bone health, to the User, via their Smart Phone.
The Building Bones Portal (currently for Building Bones designated employees and Healthcare Professionals (“HCPs”)): This is a web-based dashboard that generates and supplies reports and enables the Building Bones designated employees and HCPs to approve programs, view reports and information, and view the progress of the users. Designated Building Bones employees can use the Building Bones Portal for administrative, regulatory and research purposes (e.g. post-market surveillance activities, scientific publications, conference presentations).
This is not a medical device and nothing on the platform replaces medical advice.
Building Bones does not diagnose, treat or replace medical advice. The content is intended for educational purposes only.
Please read these Terms and Conditions (the "Terms") and the included User Statement and Acknowledgment of Risk section carefully because they govern your use of our Platform.
Agreement to Terms
By using the Building Bones App ("App") or the Building Bones Portal ("Portal"), you agree to be bound by these Terms. If you do not agree to be bound by these Terms, do not use the App or Portal.
Privacy Policy
The User acknowledges and agrees that their use of the App or Portal is also subject to our Privacy Policy for our Platform and by using the App or Portal, the User accepts the terms of same. Please refer to our Platform Privacy Policy for information on how we collect, process, use and disclose information from our Users.
Changes to Terms
We may modify these Terms and the Privacy Policy at any time, at our sole discretion. If we make material amendments, we will notify the User within the App or Portal or through other communications. It is important that you review the Terms whenever we modify them because if you continue to use the App or Portal after we have posted modified Terms, you are indicating to us that you agree to be bound by the modified Terms. If you don't agree to be bound by the modified Terms, then you may not use the App anymore and may have restricted or limited use of the Portal.
As our App and Portal may evolve over time, we may change or discontinue all or any part of the App or Portal, at any time and without notice, at our sole discretion.
Eligibility
You may not use the App or Portal if you are under 18 years or are barred from using the App or Portal under applicable laws. Please review the User Statement section for further detailed criteria.
Registration and Your Information
If you want to use the App or Portal, you will have to create an account ("Account"). You can do this via the App or Portal during the registration process (as appropriate). It is important that you provide us with accurate, complete and up-to-date information for your Account and you agree to update such information, as needed, to keep it accurate, complete and up-to-date. If you do not, we might have to suspend or terminate your Account. You agree that you will not disclose your Account password to anyone and you will notify us immediately of any unauthorised use of your Account. You are responsible for all activities that occur under your Account, whether or not you know about them.
Device Ownership and Shared Devices
You confirm that you either own the device on which you download the App and access your Account, or that you have the permission of that device's owner to do so. You are responsible, in accordance with these Terms, for use of the App on any device through which you access the Services, whether or not you own that device. If you access the App from a shared or borrowed device, you accept that another user of that device may be able to access your information unless you log out and otherwise secure your Account, and we will have no liability arising from your choice to share, or leave accessible, a device through which the Services can be accessed.
Our Services
General Description
Building Bones is a digital health and wellness platform focused on bone health and falls, providing education, exercise guidance and related tools, which may include a version of the App available free of charge and a version available on payment of a fee, as described further under Free Services and Paid Services. The Services, and the features available within them, may change over time.
Programme Generation and Personalisation
Your exercise programme is generated using decision logic, inclusion and exclusion criteria, based on the answers you provide, and a database of exercises created by Building Bones. Generative artificial intelligence is not used to create your programme. Where a programme is reviewed by a physiotherapist or other suitably qualified Healthcare Professional (“HCP”) before it is released to you, as described in the User Statement and Acknowledgment of Risk, that review is carried out as a safety and quality-control step and does not convert the Services into an individually tailored clinical consultation or an individualised program. Building Bones may separately use machine learning to help the system learn from the choices you make about a proposed programme, in order to improve the quality, safety and consistency of future recommendations; this is distinct from, and does not affect, our use of pseudonymised or anonymised data to train machine learning or artificial intelligence models as described under Use of Pseudonymised Data for Machine Learning and AI Development below.
Service Evolution
We may change the Services over time, including by adding, modifying, removing, suspending or discontinuing features, content or availability. We have no obligation to maintain any particular content or feature regardless of your level of engagement with it.
Using the App and Portal
Background
We are not health care providers nor do we hold ourselves as such. Neither the App nor the Portal is currently classified, registered, CE marked or UKCA marked or FDA approved as a medical device in any jurisdiction or in any juridsiction in which the Services are made available, including Ireland, the United Kingdom. Building Bones will comply with the medical device, health software and other regulatory frameworks applicable to the App and Portal in each such jurisdiction, as those frameworks apply to us and as they develop from time to time. Neither the App nor the Portal is intended to replace traditional methods of medical advice or diagnosis of any medical condition or treatment by your physician.
Disclaimer re. Medical Advice
The App does not seek to provide, replace or supplement medical advice. Never disregard professional medical advice or delay seeking it because of something you have read or a programme you have been given on our App. Nothing on our App should be construed as creating a physician-patient relationship between you and Building Bones. Our App is not designed for the delivery of time-sensitive or life critical medical or health-related communications. If you have any questions about your healthcare and/or the content herein, please refer to your therapist, physician, researcher and/or health care provider ("HCP") as appropriate. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition and before stopping, starting or modifying any treatment. If you are receiving treatment for a medical condition or have a medical condition, the content in the App should only be applied and/or administered with the consent of an appropriate HCP under prescription. The Platform is not intended to be an initial medical diagnosis or suggested course of treatment without the approval of a physician. Building Bones is not responsible for the treatment prescribed by any HCP regardless of whether they use the Portal. You should not disregard medical advice or delay seeking medical attention as a result of any Content (as defined below), text, photograph, image, illustration, video clip, audio clip or other materials provided on the App. Building Bones has no control over your HCP and is not responsible for any treatment prescribed by a HCP. Regardless of the Terms, any HCP access to and use of the Portal may also be subject to any other agreement you may have entered into (or will be required to enter into). Notwithstanding any other agreement, these Terms will continue to apply to your use of the Services. You understand and agree that the App and any other information you learn from Building Bones is not intended, designed, or implied to diagnose, cure, monitor, mitigate, alleviate, prevent, or treat any condition or disease, or to ascertain the state of your mental or physical health without the continuing approval and prescription from your HCP. The material provided in the App and Portal is not intended to substitute professional medical advice, diagnosis or treatment but rather complement it. Although we strive to provide accurate general information, you should not rely solely on this information. Not all activities described on the App are suitable for everyone. Always consult a professional in the area for your particular needs and circumstances prior to making any medical decisions. Do not use the App or Portal whilst driving, operating heavy machinery, or performing other tasks that require attention and concentration. If you choose to use the App or Portal, you understand and agree that you are solely responsible for your use of the App or Portal and the information contained therein.
User Statement and Acknowledgment of Risk
This User Statement and Acknowledgment of Risk applies in addition to, and does not limit or replace, the Disclaimer re. Medical Advice set out above or any other provision of these Terms. By using the App or Portal, and in particular by taking part in any exercise, balance, resistance, impact or other physical activity module made available through the Services, you expressly acknowledge, understand and agree to each of the following:
(a) Nature of the Services. The App and Portal are designed to support general bone health, exercise, education and lifestyle guidance. They do not diagnose, treat, cure or provide emergency or urgent medical care, and they are not a substitute for individualised clinical assessment, in-person examination, or an ongoing treatment relationship with a qualified HCP.
(b) Inherent risks of exercise. All physical exercise, including any resistance, balance, impact or strength training accessed through the Services, carries an inherent risk of injury. These risks include, without limitation, musculoskeletal strain or sprain, joint injury, falls, dizziness, aggravation of an existing condition and, in particular for Users with low bone density, osteopenia or osteoporosis, an increased risk of fracture including vertebral fracture. Using exercise equipment, home or gym facilities also carries inherent risk of injury. You accept these risks voluntarily as a condition of using the exercise-related parts of the Services.
(c) Your fitness to participate. You confirm that you are medically fit, or have been medically cleared where appropriate, to undertake the exercise programme(s) made available to you, and that you have sought the advice of your physician, physiotherapist or other qualified HCP before beginning any new programme where your medical history, symptoms or personal circumstances make this appropriate.
(d) Your responsibility during exercise. You are solely responsible for exercising at a pace, intensity and range of movement appropriate to your own ability, condition and circumstances; for satisfying yourself that your immediate environment (including flooring, footwear, lighting, space and the absence of hazards) is reasonably safe before beginning any exercise; and for using any equipment safely and in accordance with any instructions provided within the Services. The App may provide guidelines on the amount of exercise suggested, but these are just guidelines and you are solely responsible for setting your own pace, and intensity. We provide both written and video instructions and additional guidance where appropriate but if you are unsure it is your responsibility to ensure your technique and form is correct.
(e) Stopping exercise. You must stop exercising immediately and seek prompt medical advice or emergency assistance (as appropriate) if you experience pain, dizziness, sudden weakness, shortness of breath, chest discomfort, a fall, an injury, or any worsening of your symptoms during or after use of the Services. You must let us know immediately if you are unable to do the exercises or you experience pain or discomfort.
(f) Limits of any programme review. Where a programme generated through the App is reviewed by a chartered physiotherapist or other suitably qualified Health Care Professional or Exercise Professional before it is released to you, that review is a safety and quality-control step carried out on the basis of the information available through the Platform. It is not equivalent to an in-person or online clinical examination, a full rehabilitation assessment or the formation of or an ongoing treating relationship, and it does not convert the App or Portal into a diagnostic service or a treatment service and does not turn the generated program into an individualised program. The programme is generated based on the answers you provide in your questionnaire and exercise assessment and is reliant on your information.
(g) Third-party risk-assessment tools. Where or if the Services incorporate, refer to, or draw on the output of third-party clinical or risk-assessment tools, that output is used only to help inform the general structure of a programme and to support internal programme logic and safety review. Building Bones does not control, and is not responsible for, the availability, methodology, accuracy, updates or output of any such third-party tool, and no such output is, or is intended to be, an individual diagnosis or individual assessment of your fracture risk.
(h) No emergency or urgent care service. The App, the Portal and any associated help or support function are not monitored on a live, real-time or emergency basis and are not designed to be used in a medical emergency. If you believe you are experiencing a medical emergency, you should contact emergency services or attend an emergency department immediately, and should not rely on the App, the Portal or any support channel referred to in the Services.
(i) Voluntary participation and assumption of risk. Your participation in any exercise, Assessment or other activity made available through the Services is voluntary. To the fullest extent permitted by applicable law, and without limiting any right that cannot lawfully be excluded (including in respect of death or personal injury caused by negligence, or any right you have under mandatory Irish or UK or other relevant consumer protection law), you assume responsibility for any injury, loss or damage arising from your voluntary participation in any exercise or activity made available through the Services.
(j) You must not use the App if you have been advised not to by a medical or healthcare professional, if you have had a vertebral fracture within the last year, if you have had any fracture within the last 3 months or have a current suspected fracture, or if you have been told it is not safe for you to exercise or to exercise unsupervised. If you are at a high fracture risk The App may not be appropriate for you to use. If you are unsure please check with your HCP or physician before using the App.
(k) Confirmation. By continuing to use the App or Portal, and in particular before beginning any exercise programme, you confirm that you have read, understood and accepted this User Statement and Acknowledgment of Risk in full.
Future Functionality
You agree that your use of the App or Portal is not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by Building Bones regarding future functionality or features.
Feedback
We welcome feedback, comments and suggestions for improvements to the App and/or Portal ("Feedback"). You can submit Feedback by emailing us at info@buildingboneshealth.com or by providing it through the App. By submitting feedback, comments and/or suggestions you grant to us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable and transferable licence under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon and otherwise exploit the Feedback for any purpose.
Content and Content Rights
For purposes of these Terms, (i) "Content" means text, graphics, images, music, software, audio, video, animations, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the App or Portal; and (ii) "User Content" means any Content that Users (including you) provide to be made available through the App or Portal. Content includes without limitation User Content.
Content Ownership
Building Bones does not claim any ownership rights in any User Content and will only use same in line with these Terms and our Privacy Policy. Nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit your User Content. Subject to the foregoing, Building Bones and its licensors exclusively own all rights, title and interest in and to the App, Portal and Content, including all associated intellectual property rights. You acknowledge that the App, Portal and Content are protected by copyright, trademark, and other laws of the Republic of Ireland and other countries. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the App, Portal or Content.
Rights in User Content Granted by You
By making any User Content available through the App or Portal you hereby grant to Building Bones a non-exclusive, transferable, sublicensable, worldwide, royalty-free licence to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform and distribute your User Content in connection with operating and providing the App, Portal and Content to you and to other Users. In compliance with our Privacy Policy, we may use pseudonymised data for statistical analysis, research, or other purposes, but as it is pseudonymised it will not be linked back to you.
Use of Pseudonymised Data for Machine Learning and AI Development
In addition to the uses described above, and in compliance with our Privacy Policy, you acknowledge and agree that Building Bones may use pseudonymised or anonymised data derived from your User Content and Health Data (including exercise data, Assessment responses, session logs and outcomes) to develop, train, test, validate and improve machine learning models, algorithms and artificial intelligence systems, whether developed and operated by Building Bones internally or by third-party artificial intelligence or machine learning service providers engaged by Building Bones for that purpose. Where such data is shared with a third-party provider for this purpose, Building Bones will only do so under contractual terms that require the third party to protect the data, to use it solely for the purposes instructed by Building Bones, and not to attempt to re-identify you. Use of your pseudonymised or anonymised data for these purposes is intended to be an integral part of how the Services are developed and improved. This clause does not, and cannot, remove any right you may have under applicable data protection law (including any right to object to or restrict particular processing, or any requirement for us to obtain your explicit consent to a particular use of special category health data) where such a right or requirement applies notwithstanding this clause.
Rights in Content Granted by Building Bones
Subject to your compliance with these Terms, Building Bones grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to download, view, copy and display the Content solely in connection with your permitted use of the App and Portal and solely for your personal and non- commercial purposes.
Rights and Terms for the App and Portal
Rights in App and Portal Granted
Subject to your compliance with these Terms, Building Bones grants you a limited non-exclusive, non-transferable, non-sublicensable licence to download, use and/or install a copy of the App on a mobile device that you own or access and use the Portal (as appropriate) solely for your own personal non-commercial purposes. Building Bones reserves all rights in and to the App and Portal not expressly granted to you under these Terms. You may not copy the App or Portal. As expressly permitted in these Terms, you may not: (i) copy, modify or create derivative works based on the App or Portal; (ii) distribute, transfer, sublicense, lease, lend or rent the App or Portal to any third party; (iii) reverse engineer, decompile or disassemble the App or Portal; or (iv) make the functionality of the App or Portal available to multiple Users through any means.
Prohibitions
You agree not to do any of the following:
Post, upload, publish, submit or transmit any Content that: (i) infringes, misappropriates or violates a third party's patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any person or entity; or (vii) promotes
illegal or harmful activities or substances;
Use, display, mirror or frame the App or Portal, or any individual element within the App or Portal, Building Bones' name, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Building Bones' express written consent;
Access, tamper with, or use non-public areas of the App or Portal, Building Bones' computer systems, or the technical delivery systems of Building Bones' providers;
Attempt to probe, scan, or test the vulnerability of any Building Bones system or network or breach any security or authentication measures;
Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Building Bones or any of Building Bones' providers or any other third party (including another User) to protect the Building Bones App;
Attempt to access or search the App or Portal or download content from the App or Portal through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Building Bones or other generally available third-party web browsers;
Send any unsolicited or unauthorised advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;
Use any meta tags or other hidden text or metadata utilising a Building Bones logo, URL or product name without Building Bones' express written consent;
Use the App or Portal for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms;
Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the App or Portal to send altered, deceptive or false source-identifying information;
Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the App or Portal;
Interfere with, or attempt to interfere with, the access of any User, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the App or Portal;
Collect or store any personally identifiable information from the App or Portal from other Users without their express permission;
Impersonate or misrepresent your affiliation with any person or entity;
Violate any applicable law or regulation; or
Encourage or enable any other individual to do any of the foregoing.
Although we are not obligated to monitor access to or use of the App, Portal or Content or to review or edit any Content, we have the right to do so for the purpose of operating the App and Portal to ensure compliance with these Terms, and to comply with applicable law or other legal requirements. We reserve the right, but are not obligated, to remove or disable access to any Content, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Content to be objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or conduct that affects the Portal or App. We may also consult and cooperate with law enforcement authorities to prosecute Users who violate the law.
Links to Third-Party Websites or Resources
The App and Portal may contain links to third-party websites or resources that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the policies of every site you visit. We have no control over and assume no responsibility for the content, policies or practices of any third-party sites or services.
Termination
We may terminate your access to and use of the App or Portal, at our sole discretion, at any time and without notice to you. Upon any termination, discontinuation or cancellation of the App, Portal or your Account, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
Account Deactivation and Cancellation by You
You may deactivate your Account, or stop using the Services, at any time. If you hold a Paid Services subscription, cancellation will generally take effect at the end of the then-current billing period unless applicable law requires otherwise. Following deactivation, you may lose access to stored content, your progress, and other Account data or functionality, subject to applicable law and to our data retention obligations, as further described in our Privacy Policy. We may retain certain data after deactivation where required by law, or for safety, dispute-resolution, fraud-prevention, regulatory or other legitimate operational reasons.
Warranty Disclaimers
The App and Portal and content are provided "as is," without warranty of any kind. Without limiting the foregoing, to the extent permissible we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement and any warranties arising out of course of dealing or usage of trade.
Indemnity
You will indemnify and hold harmless Building Bones and its officers, directors, employees and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use or misuse of the App, Portal or Content and/or (ii) your violation of these Terms.
Limitation of Liability
To the maximum extent permitted by applicable law neither Building Bones nor any other party involved in creating, producing, or delivering the App, Portal, products or Content will be liable for any incidental, indirect, special, exemplary or consequential damages, including, but not limited to, personal injury, lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute App arising out of or in connection with these Terms or from the use of or inability to use the App, Portal or Content, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Building Bones has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. In no event will Building Bones' total liability arising out of, or in connection with, these Terms, or from the use of or inability to use the App or Portal or Content exceed the amounts you have paid to Building Bones for use of the App or Portal or Content, or one hundred euros (€100.00) if you have not had any payment obligations to Building Bones, as applicable. The exclusion and limitations of damages set forth above are fundamental elements of the basis of the bargain between Building Bones and you. The laws of some jurisdictions impose restrictions on limiting liability. Nothing herein shall exclude our liability where it would be unlawful to do so. Where any provision is expressed to exclude or limit liability to a greater extent than permitted by law, that provision shall be deemed to only exclude or limit our liability to the maximum extent permitted by law.
Governing Law
These Terms and or dispute that might arise related thereto will be interpreted and governed by the laws of the Republic of Ireland without regard to any conflict-of-law or other principles that provide for the application of the law of another jurisdiction.
You and Building Bones agree to submit to the exclusive jurisdiction of the courts of the Republic of Ireland in relation to any such dispute, save that Building Bones may seek injunctive relief in any jurisdiction in order to enforce its rights under these Terms, and save for any mandatory right you may have under applicable consumer protection law (including UK consumer protection law, where applicable) to bring proceedings in the courts of the country in which you are resident.
Building Bones is based in the Republic of Ireland. We provide the Services for use only by persons located in the Republic of Ireland, the United Kingdom, and may later extend these to Canada and the United States of America and other jurisdictions. We make no claims that the Services or any of their content is accessible or appropriate outside of these territories. Access to the App or Portal may not be legal for certain persons or in certain countries. You should not access the Services from outside the Republic of Ireland, or the United Kingdom at present. If you do, you do so on your own initiative and are responsible for compliance with local laws.
Free Services and Paid Services
Free Services
We may make certain parts of the Services available to you free of charge as Free Services. We may modify, limit, suspend or withdraw any Free Services, or convert a Free Service into a Paid Service, at any time.
Paid Services
Some parts of the Services are, or will be, made available only on payment of a fee ("Paid Services"). Paid Services may include more personalised programme functionality, tracking, progression features, enhanced support, expanded content, and other premium features. Features available in the Free Services and the Paid Services may differ, and we may change which features are included in each from time to time.
Pricing and Payment
The price, billing interval, applicable taxes and other key commercial terms of any Paid Services will be presented to you clearly before you purchase them, and are subject to change. Payments may be processed through a third-party payment processor or through the relevant app store. We do not store your full payment card details where a third-party payment processor handles those details on our behalf. Payment processing is subject to the relevant payment provider's own terms and privacy practices, over which we have no control and for which, to the fullest extent permitted by law, we accept no responsibility.
Auto-Renewal and Cancellation
If a subscription is offered on a recurring basis, it may renew automatically at the end of each billing period unless you cancel it before that period ends. If you make a purchase through the Apple App Store or Google Play, that purchase, and any cancellation of it, may also be subject to the relevant app store provider's own terms. If a payment fails, we may suspend or restrict your access to the relevant Paid Services until payment is successfully completed.
Refunds and Consumer Rights
Any right you have to a refund will be subject to applicable law, including your mandatory consumer rights relating to digital content and digital services, which may differ from the rights that apply to physical goods where digital content is supplied to you immediately on request. Nothing in these Terms is intended to exclude or restrict any right you have under mandatory Irish or UK consumer protection law, including (without limitation) the Irish Consumer Rights Act 2022 and the UK Consumer Rights Act 2015, in each case to the extent applicable to you and to the Paid Services.
Our Practitioners, Healthcare Professionals, Coaches and Advisors
We engage a range of subject matter experts from time to time to help develop and deliver Building Bones Content, some of whom may be featured or promoted through the Services or our social media accounts. These practitioners may be independent contractors and are not subject to our instruction or control beyond their limited engagement to develop or deliver content for the Services. By featuring or promoting a practitioner, we do not endorse, and make no warranty or representation about, any service that practitioner provides independently of the Services. If you engage directly with any practitioner outside of the Services, we have no responsibility or obligation to you in connection with that engagement or its outcome. We may change or replace any practitioner featured through the Services at our discretion, and your affinity with, or engagement in respect of, a particular practitioner's content does not oblige us to continue to feature that practitioner or their content.
Third-Party Service Providers and Communications
Third-Party Service Providers
We use third-party service providers to help us operate, host and support the App and Portal and to provide the Services to you. These may include, without limitation, cloud hosting providers, payment processing providers, analytics providers, customer support tools, and email and marketing communications providers. These third-party providers process data on our behalf and/or provide infrastructure or software that supports the Services, and their involvement does not change our responsibilities to you under our Privacy Policy. We are not responsible for the acts, omissions, availability, security or content of any third-party service provider, save to the extent required by applicable law or by our contractual arrangements with that provider. Further detail on the specific third-party providers we use and the categories of data shared with them is set out in our Privacy Policy.
Third-Party Contractors
We may engage third-party contractors, including software developers and engineers, to help build, host or maintain the App and Portal. Any such contractor is not a Building Bones employee. Each. such contractor is required, under the terms of our engagement with them, to keep confidential any information they access in the course of that engagement and, to the extent they process data on our behalf, to comply with data protection obligations equivalent to those that apply to our own employees.
Marketing Communications
Where we send you marketing communications (as distinct from essential service, account, billing or security-related messages, which you cannot opt out of while using the Services), we will do so in accordance with applicable law, including any requirement to obtain your consent and to provide a means of opting out. Marketing emails sent through our email and marketing communications provider will include a means of opting out of future marketing communications (such as an unsubscribe link) as required by applicable law. You may also opt out of, or update your preferences regarding, marketing communications at any time by emailing us at info@buildingboneshealth.com. Opting out of marketing communications will not affect your ability to use the Services or your receipt of essential service communications.
General Terms
These Terms constitute the entire and exclusive understanding and agreement between Building Bones and you regarding the App, Portal and Content, and these Terms supersede and replace any and all prior oral or written understandings or agreements between Building Bones and you regarding the App, Portal and Content save with respect to the Privacy Policy. If any provision of these Terms is held invalid or unenforceable that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
You may not assign or transfer these Terms, by operation of law or otherwise, without Building Bones' prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. Building Bones may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.
Any notices or other communications provided by Building Bones under these Terms, including those regarding modifications to these Terms, will be given: (i) by Building Bones via email; or (ii) by posting to the App or Portal (as appropriate). For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
Building Bones' failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorised representative of Building Bones. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
We will not be liable or responsible for any failure to perform, or delay in performing, any of our obligations under these Terms that is caused by an event beyond our reasonable control, including failure of public or private telecommunications networks, cyber incidents, pandemics, governmental action, natural disasters, or failure of third-party infrastructure ("Event Outside Our Control"). Where an Event Outside Our Control affects our performance of these Terms, our obligations will be suspended for the duration of that event, and we will use reasonable endeavours to find a way to perform our obligations despite the Event Outside Our Control.
Complaints
If you have a complaint about the App or Platform, please contact us using the details set out under Contact Information below. We will seek to acknowledge and review complaints within a reasonable timeframe. Nothing in this clause affects any right you have to raise a complaint with a relevant regulator or consumer body, including (in respect of data protection matters) the Data Protection Commission in Ireland or the Information Commissioner's Office in the United Kingdom, as applicable.
